Terms of Service

These Terms of Service (“Terms”) govern your use of understorynutrition.com (the “Site”) and any purchase you make from it. The Site is operated by Vista Versant LLC, doing business as Understory Nutrition (“Understory,” “we,” “us”). By using the Site or placing an order, you agree to these Terms. If you don’t agree, please don’t use the Site.

1. Eligibility

You must be at least 18 years old and able to enter a binding contract to purchase from the Site. By ordering, you confirm that the information you provide is accurate and that you’re authorized to use the payment method you submit.

2. Products and health information

• Follow the directions on the label. Do not exceed the recommended serving.
• Our capsule contains iron. Accidental overdose of iron-containing products is a leading cause of fatal poisoning in children under 6. Keep this product out of reach of children. In case of accidental overdose, call a doctor or poison control center immediately.
• Individual results vary. Any testimonials, reviews, or statistics on the Site reflect specific experiences or cited research and are not a promise of what you will experience.
• Research summaries and citations on the Site are provided for context. They describe studies of individual ingredients or populations, not clinical trials of our finished product, unless expressly stated.
• Stop use and contact your clinician if you experience an adverse reaction.

3. Orders, pricing, and payment

• Placing an order is an offer to buy. We accept it when we send a shipping confirmation. We may cancel or refuse any order — for example, if a product is out of stock, a price was listed in error, or we suspect fraud — and will refund any amount already charged.
• All prices are in U.S. dollars and may change without notice. Applicable taxes and shipping are shown at checkout before you pay.
• Promotional pricing and discount codes can’t be combined unless we say otherwise, and may be withdrawn at any time.
• Payment is processed by third-party providers. We don’t store your full card details.

4. Subscriptions

• If you choose a subscription, you authorize us to charge your payment method at the subscription price, at the interval you selected, until you cancel.
• You can cancel any time from your account page or by emailing vistaversant@gmail.com. Cancellation stops future charges; it doesn’t refund a shipment that has already been processed.
• Subscription pricing reflects a discount off the one-time price and applies only while the subscription is active.
• We’ll notify you by email before any change to your subscription price takes effect.

5. Shipping

We currently ship within the United States. Orders typically arrive within 7 business days of being placed, and you’ll receive a tracking link by email once your order ships. Delivery estimates aren’t guarantees; carrier delays happen. Risk of loss passes to you on delivery to the address you provided. Please double-check your address — we can’t recover orders shipped to an incorrect address you entered.

6. Returns and the 60-Day Guarantee

Returns and refunds are handled under our Return & Refund Policy, which is part of these Terms. In short: try it for 60 days from delivery, and if it isn’t for you, send the bottle back — even partly used — for a refund.

7. Your account and conduct

If you create an account, you’re responsible for keeping your login secure and for activity under it. You agree not to:

• use the Site for any unlawful purpose or in a way that could damage or impair it;
• scrape, copy, or reproduce Site content for commercial use without our written permission;
• submit false reviews, orders, or information; or
• resell our products without authorization.

8. Reviews and submissions

If you leave a review, comment, or other content on the Site, you grant us a perpetual, royalty-free license to use, edit, and display it in connection with our business. You confirm it’s your own, it’s honest, and it doesn’t violate anyone else’s rights. We may remove any submission at our discretion.

9. Intellectual property

The Site and everything on it — the Understory name and mark, logos, label designs, copy, images, and layout — belong to Vista Versant LLC or our licensors and are protected by trademark and copyright law. You may not use them without our written permission.

10. Third-party links and services

The Site may link to third-party sites (for example, published research) or rely on third-party services for payment, shipping, and email. We don’t control those parties and aren’t responsible for their content or practices.

11. Disclaimer of warranties

Except for the 60-Day Guarantee described above, the Site and our products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Site will be uninterrupted or error-free.

12. Limitation of liability

To the fullest extent permitted by law, Vista Versant LLC and its members, employees, and suppliers won’t be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products. Our total liability for any claim is limited to the amount you paid us for the product or order giving rise to the claim. Some states don’t allow these limitations, so some may not apply to you.

13. Indemnification

You agree to defend and hold harmless Vista Versant LLC from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your misuse of the Site or our products.

14. Governing law and disputes

These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-law rules.

If you have a problem, email us first — most issues get sorted in a couple of messages. If we can’t resolve it informally within 30 days, any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court. You and Understory each waive the right to a jury trial and to participate in a class or representative action.

You may opt out of this arbitration clause by emailing us within 30 days of your first purchase with your name, order number, and a statement that you opt out.

15. Changes to these Terms

We may update these Terms from time to time. The date at the top tells you when they last changed. Continuing to use the Site after a change means you accept the updated Terms. Material changes to subscription terms will be emailed to active subscribers before they take effect.

16. General

If any part of these Terms is found unenforceable, the rest still applies. Our failure to enforce a provision isn’t a waiver of it. These Terms, together with our Return & Refund, Shipping, and Privacy Policies, are the entire agreement between you and us regarding the Site.
